Our Role in Accountability
- In many fraud cases, the individual scammer cannot be meaningfully pursued. They may be overseas, incarcerated, or judgment-proof. Recovery often depends on identifying legally responsible third parties—institutions whose failures in oversight, security, supervision, or compliance allowed harm to occur or continue.
- Our work centers on that analysis. We pursue claims where the law provides a basis for holding institutions accountable and where recovery is realistically achievable.
Contingency Representation and Judgment
- MDF Law represents clients on a contingency fee basis, meaning there are no hourly legal fees and no fee unless a recovery is obtained.
- This structure aligns our interests with those of our clients and serves as an internal discipline. We evaluate cases carefully before accepting them, because we assume the financial risk of litigation alongside the people we represent.
- We believe contingency representation should also be transparent. Our client agreements are intentionally straightforward and as concise as legally permitted. We do not believe clients should be required to surrender control or sign away rights simply to obtain representation.
Firm Leadership
MDF Law is led by Marc Fitapelli and Jeffrey Saxon, attorneys with more than 35 years of combined legal experience representing plaintiffs against financial institutions and corporate defendants.
Marc Fitapelli, the firm’s founder, is licensed to practice law in New York and has spent his career representing injured investors and consumers. He has helped clients recover hundreds of millions of dollars from major financial institutions, broker-dealers, and insurance companies. Marc regularly represents clients before FINRA, the American Arbitration Association, and courts nationwide. He has been recognized as a Super Lawyer and is a member of the Million Dollar Advocates Forum.

Jeffrey Saxon is licensed to practice law in both New York and California and is based in Carlsbad, California. He is a seasoned civil litigator with extensive experience in state and federal courts handling complex negligence, fraud, and commercial matters. Prior to joining MDF Law, Jeff served with the New York City Department of Correction.
